These Terms & Conditions ("Terms") govern your use of vandermude.com (the "Site"), operated by Antony Van der Mude LLC ("the Company," "I," "me," or "my"), and your participation in the Company's SMS text-messaging program. By using the Site, submitting the client sign-up form, or opting in to text messages, you agree to these Terms and to the Privacy Policy.
You may use the Site for lawful purposes only. You agree not to interfere with the Site's operation, attempt to gain unauthorized access to it, submit false or misleading information through its forms, or use automated means to submit forms.
Submitting the sign-up form expresses your interest in consulting services; it does not by itself create a contract for services. Any engagement will be governed by a separate written agreement between you and the Company. I may decline any inquiry at my discretion.
When you opt in by checking the SMS consent box on https://vandermude.com/signup.html, you agree to receive SMS text messages from Antony Van der Mude LLC at the mobile number you provided. Messages are conversational and transactional and relate to your consulting engagement — for example, scheduling, project updates, and replies to your inquiries. I do not send marketing or promotional text messages.
Message frequency varies depending on the activity of your engagement.
Message and data rates may apply. Check with your mobile carrier for details of your messaging plan. I do not charge for text messages, but your carrier may.
You can cancel the SMS service at any time by replying STOP to any message. After you send STOP, I will send you one final SMS message to confirm that you have been unsubscribed, and you will no longer receive SMS messages from me. If you want to join again, simply fill in the sign-up form again as you did the first time, and I will start sending SMS messages to you again.
If you are experiencing issues with the messaging program, reply HELP to any message for more assistance, or email vandermude@vandermude.com.
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator.
Your mobile number and your opt-in consent are handled as described in the Privacy Policy. In particular, no mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Unless otherwise noted, the content of the Site — text, essays, images, and logos — is owned by Antony Van der Mude and may not be reproduced without permission, except for brief quotations with attribution. Published papers linked from the Site are subject to their publishers' terms.
The Site is provided "as is" and "as available." I make no warranties, express or implied, regarding the Site's availability, accuracy, or fitness for a particular purpose. Information on the Site is general in nature and is not professional advice for your specific situation.
To the fullest extent permitted by law, Antony Van der Mude LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or the SMS program. Nothing in these Terms limits liability that cannot be limited under applicable law.
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in Massachusetts.
I may revise these Terms from time to time. The effective date at the top will change when I do. Continued use of the Site or the SMS program after a change constitutes acceptance of the revised Terms.
